Governor Lynch Signs SB197

Effective January 1, 2008, insurance companies are required to allow divorced spouses and dependents to remain on the ex-spouses policy for up to three years.

Senate Bill 197 was signed by Governor Lynch and will become effective January 1, 2008. The bill requires the continuation of group health insurance in the event of divorce or legal separation. The individual, surviving spouse, or dependent shall be responsible for payment of premiums which may include an administrative fee not to exceed 2 percent of the monthly premium to the employer or policyholder throughout the extension period.
