House Bill 158: 90-day prescription drug supply

July 16, 2007

Allows insureds to purchase a 90-day supply of covered prescription drugs

Effective August 10, 2007 insureds may purchase an up-to-90-day supply of prescription drugs on the covered person's health plan formulary at one time. Conditions of purchase include the following: insured must demonstrate that they have taken the drug for a continuous period of one year and provided that the drug is not subject to the health plan's utilization management, prior authorization, or pre-certification requirements. Controlled substances as defined by the United States Drug Enforcement Administration are exempt from this provision.

This bill does not limit the health plan's ability to establish copays, coinsurance deductibles or other member cost shares.
