ACA Subsidies Fate Uncertain

Two different courts rendered opposing decisions on whether non-state exchanges can offer subsidies to ACA enrollees. Several comments made by ACA author, Jonathan Gruber were released over the weekend suggest that he believed that the law was written so only state run exchanges could offer the subsidies. Others offer that this was deliberately written into the law because it was feared that some states would not create exchanges. As it turns out, a majority of states did not create exchanges and if the ruling that non-state exchanges cannot offer the subsidies, many enrollees in those states could find themselves paying the non-subsidized premium. Many states are scrambling to make changes to not be adversely affected.
